Loudspeakers, amplifiers banned in Shopian markets for two months

Shopian: The District Magistrate Shopian has imposed a complete ban on the use of loudspeakers, public address systems, microphones, and other sound-amplifying equipment across the district, declaring noise pollution a public nuisance under Section 163 of the Bharatiya Nagarik Suraksha Sanhita, 2023

According to the order issued today, the decision follows numerous complaints and direct observations indicating that excessive and avoidable noise pollution in Shopian town and other marketplaces has been causing serious disturbance to public peace, health and tranquility. The order specifically points to hawkers, vendors and shopkeepers using loudspeakers and amplifiers for advertising purposes, creating severe inconvenience to inhabitants, shoppers and visitors

The District Magistrate noted that vehicles including vans, auto rickshaws and handcarts fitted with loudspeakers for promotional activities and announcements have also emerged as a major source of noise pollution, affecting both residential and commercial areas. Unrestricted use of public address systems, vehicular horns, generator sets, construction activities and social or religious gatherings beyond permissible limits has also been termed a public nuisance under law

Invoking Article 21 of the Constitution, the order states that citizens have a right to life that includes a wholesome environment free from hazardous noise pollution. In exercise of powers vested under BNSS, the District Magistrate has strictly prohibited the use of sound amplifying equipment by shopkeepers, vendors and hawkers for advertising or selling goods, directing immediate removal or disconnection of such devices. Use of vehicles mounted with loudspeakers for announcements, music or advertisements has also been completely banned unless permitted under rules

For enforcement, the Senior Superintendent of Police, Shopian, has been directed to ensure strict implementation of the order. Police officials have been authorised to seize loudspeakers, amplifiers and microphones found in violation. Tehsildars and Sub Divisional Magistrates have been instructed to act promptly on complaints, while municipal authorities have been asked to give wide publicity to the order and ensure compliance

The order will remain in force for a period of two months from January 1, unless revoked or modified earlier. Authorities have warned that any violation will invite strict action under relevant provisions of law. [KNT]
