Asks Authorities To Submit Compliance Report By May 6
Srinagar: A court here has directed Enforcement Officer J&K Lake Conservation and Management Authority (LCMA) to implement “status quo” with regard to nature of land at Pandithpora Rainawari Srinagar.
The Court of 1st Additional Munsiff Srinagar passed the orders following an application by one Bashir Ahmad, alleging breach of the ‘status quo’ by the defendants.
“…By virtue of order dated 08.10.2010, parties had been directed to maintain status quo with regard to the suit property and vide order dated 15.07.2011, the temporarily injunction/relief order has been made absolute,” the court said, adding, “Furthermore, by virtue of order dated 26.02.2014, parties were directed to maintain status quo with regard to the nature and the possession of the suit land by the Worthy Additional District Judge, Srinagar.”
The court said that its order should be respected by the parties and underlined that if the same was not done, it will be left with no option but to get the same implemented through other independent agencies.
“Since, the order of the court is in vogue and the applicant is on affidavit alleging that the same is being violated by the non-applicants, Enforcement Officer J&K LCMA is directed to proceed on spot and inform the non-applicant as regards the order of this court dated 26.02.2014,” the order said, adding, “if need arises implement the same in its letter and spirit.
However, Enforcement Officer J&K LCMA is reminded that this order shall not mean to dispossess any party or to harass either of the parties.”
The Court ordered Enforcement Officer to file compliance report before it Court by or before next date of hearing on May 6. (GNS)
